Limited License; Permitted Uses: You are granted a non-exclusive, non-transferable, revocable license (A) to access and use the Site strictly in accordance with this Agreement; (B) to use the Site solely for internal, personal, non-commercial purposes; and (C) to print out discrete information from the site solely for internal, personal, non-commercial purposes and if you maintain all copyright and other policies contained therein.

Unlawful Activity: We reserve the right to investigate complaints or reported violations of this Agreement and to take any action we deem appropriate, including but not limited to reporting any suspected unlawful activity to law enforcement officials, regulators, or other third parties and disclosing any information necessary or appropriate to such persons or entities relating to your profile, email addresses, usage history, posted materials, IP addresses and traffic information.
Indemnification: You agree to indemnify, defend and hold us and our partners, agents, officers, directors, employees, subcontractors, successors, assigns, third party suppliers of information and documents, advertisers, product and service providers, and affiliates (collectively, “Affiliated Parties”) harmless from any liability, loss, claim and expense related to your violation of this Agreement or use of the site.
Nontransferable: Your right to use the site is not transferable or assignable. Any password or right given to you to obtain information or documents is not transferable or assignable.

Third-Party Services: We may allow access to or advertise certain third-party product or service providers (“Vendors”) from which you may purchase certain goods or services. You understand that we do not operate or control the products or services offered by such Vendors. Vendors are responsible for all aspects of their order processing, fulfillment, billing and customer service. We are not a party to the transactions entered into between you and Vendors. You agree that use of or purchase from such Vendors is AT YOUR SOLE RISK AND IS WITHOUT WARRANTIES OF ANY KIND BY US, EXPRESSED, IMPLIED OR OTHERWISE INCLUDING WARRANTIES OF TITLE, FITNESS FOR PURPOSE, MERCHANTABILITY OR NON-INFRINGEMENT. UNDER NO CIRCUMSTANCES ARE WE LIABLE FOR ANY DAMAGES ARISING FROM THE TRANSACTIONS BETWEEN YOU AND VENDORS OR FOR ANY INFORMATION APPEARING ON MERCHANT SITES OR ANY OTHER SITE LINKED TO OUR SITE.
Third-Party Vendor Policies: All rules, policies (including privacy policies) and operating procedures of Vendors will apply to you while on any Vendor sites. We are not responsible for information provided by you to Vendors. We and the Vendors are independent contractors and neither party has authority to make any representations or commitments on behalf of the other.
Privacy Policy: Our Privacy Policy, as it may change from time to time, is a part of this Agreement.
Disclosure Policy: Our Disclosure Policy, as it may change from time to time, is a part of this Agreement.
Payments: You represent and warrant that if you are purchasing something from us or from Vendors that (i) any credit information you supply is true and complete, (ii) charges incurred by you will be honored by your credit card company, and (iii) you will pay the charges incurred by you at the posted prices, including any applicable taxes.
Links to other Web Sites: The Site contains links to other web sites. We are not responsible for the content, accuracy or opinions express in such Web sites, and such web sites are not investigated, monitored or checked for accuracy or completeness by us. Inclusion of any linked web site on our site does not imply approval or endorsement of the linked web site by us. If you decide to leave our site and access these third-party sites, you do so at your own risk.
Legal Compliance: You agree to comply with all applicable domestic and international laws, statutes, ordinances and regulations regarding your use of the site and the Content and Materials provided therein.
SearchParts.com typically does not warehouse parts and therefore uses third party suppliers to fill most of its orders. SearchParts obtains data and information regarding its parts from various third party sources and, therefore, cannot guarantee the accuracy of such data and information.
While we take reasonable steps to ensure all information is accurate and up to date, it is possible that certain parts indicated as being "available" may not be available at the time SearchParts attempts to fill your order. In the event that the exact part you chose is unavailable we will fill your order with a part that equals or exceeds the specifications displayed on our site with respect to warranty, mileage, condition and/or delivery time.
Accordingly, Customer acknowledges and agrees that SearchParts is not responsible for the accuracy or the timeliness of the information displayed on this site, the inability to provide the exact part identified on this site, or the inability to fill an order despite the indication that the part is available.
General Disclaimer About Used Parts The industry standard for a used part warranty is: Parts are warranted to be the correct part and in working order. No warranty or guarantee is made towards the appearance or condition of a part unless otherwise noted.
Claims On Defective Or Incorrect Used Parts: If a part fails in normal use or service, SearchParts.com has the option to: repair the part, furnish a replacement part, or refund the price of the part. Any claim on a defective or incorrect part must be made via e-mail to SearchParts.com within the warranty period for that part. Once a SearchParts.com assigns a Return Merchandise Authorization (RMA) Number, the part must be returned to the specified supplier for verification that it is the same part they sent and is indeed defective. Upon return, the part must be in the same condition as when sold. It is agreed that the sole determiner of condition for return is the supplier of the part. No refund or exchange can be made until the part supplier verifies the part's condition. There are NO returns on altered, disassembled or overheated parts.
Claims On Defective Or Incorrect New Or Rebuilt Parts: If "New" or "Rebuilt" is indicated, the warranty will be null and void if the part has been installed or attempted to be installed and is being returned for any other reason than the part is mechanically defective. New and rebuilt parts are warranted by their respective manufacturer and will be repaired, replaced or refunded based on the manufacturer's terms and conditions. Buyer's remedy against seller shall only be return of the price of the part or replacement of the part.
Core Return Policy: There are no core refunds if the core is not able to be reworked to operate within the manufacturer's specifications. E-mail SearchParts.com immediately for a Return Merchandise Authorization (RMA) number. No action will be taken without the RMA number. Once a SearchParts.com Partsologist assigns a RMA number, the core must be returned to the supplier within 30 days of receipt of the part.
Freight Damage Claims: Any claims of freight damage must be noted with the freight carrier's driver at the time of delivery on the documents from the freight carrier. In most cases SearchParts.com will initiate a freight damage claim for the buyer provided the buyer has noted with freight carrier of the damage at time of receipt. If not noted at time of receipt, a claim may be made on behalf of the buyer but the part may not be warranted and any claim acceptance or denial is at the discretion of the freight carrier.
Shipping: Most parts are shipped via UPS Ground. Shipping times range from 3 to 7 business days depending on the supplier's location and your "ship-to" address. To guarantee arrival to the "ship-to" address, you, the customer, authorize the shipper to deliver and leave the part(s) at the ship-to address without requiring a signature.
Due to the excessive weight or size of some parts, the customer must have the mechanical means (i.e. a winch or lift gate truck) to unload a part from a shipper's payload height of at least 4 feet 6 inches. It is the customer's responsibility to be aware of this need and pay the shipper any additional fees if the customer cannot unload the part. The customer's inability could also affect the final delivery of the part.
Canceled Orders: Orders cannot be cancelled after the order has been received by the shipping carrier. Orders cancelled after the part has been received by the shipping carrier are subject to a 20% restocking fee and possibly to the cost of the freight both ways if the part has been shipped. If an order is cancelled before it is received by the freight carrier the customer may still be responsible for a restock fee.
Special Orders For Parts Not Displayed In Results: There are no returns or refunds on special orders. Exchanges may be made at the discretion of the supplier.
Advice: If technical or mechanical advice is offered or given in connection with a purchase it will be as an accommodation to the purchaser and without charge. Neither Searchparts.com nor the part supplier shall have ANY responsibilities or liabilities whatsoever for the content or use of such advice.
Fees: The purchaser understands that certain engines, transmissions and special parts purchased through SearchParts.com may require a special delivery truck for residential deliveries (non-commercial address). In that event, the purchaser agrees to pay any additional residential delivery fees.
The following are industry standards and policies for warranty consideration. The original purchaser must make all claims in writing by email to support@SearchParts.com within the warranty period. Buyer must inspect all parts for defects or safety hazards. There are NO guarantees or warranties on used merchandise for apparent or non-apparent safety hazards. Used parts or merchandise may have defects and it is the responsibility of the buyer to inspect for actual or latent hazards or hire an expert to so inspect. The use of the part for diagnostic purposes voids all warranties. Warranties are not transferable. Parts ordered in error by the customer will be subject to restocking fees and freight charges. It is ultimately the customer’s responsibility to know and order the exact part needed.
Specific Part Information:
AC COMPRESSORS When installing an AC compressor, whether new, rebuilt or used, the customer must install a new drier to validate any warranty.
CARBURETORS are warranted to be a rebuildable core only unless otherwise noted.
CYLINDER HEADS are warranted to be free of cracks and to be rebuildable only unless otherwise noted.
ELECTRICAL PARTS are warranted for exchange only, no refunds allowed. The part must be tested by the supplier to ensure it is defective and not made so by another component on your vehicle. There are no warranties on overheated, burned, shorted, or overloaded parts.
BODY PARTS are not sold as a color match part unless otherwise noted. In some cases parts may be supplied in like color but all painted body parts are sold with the expectation that the purchaser is going to refinish and paint the part.
ENGINES, TRANSMISSIONS, DRIVE AXLES, and DIFFERENTIALS all require new fluids of proper viscosity and/or type. New filters, new seals, and new gaskets must be used during installation or warranty is null and void.
ENGINE AND ENGINE ASSEMBLIES are sold as a long block assembly only, which includes just the block and cylinder head(s). Any other parts that are included are not guaranteed and are only provided for customer’s convenience
All USED ENGINES installed must meet the following requirements to qualify for supplier warranty:
Thoroughly clean all units such as oil pan, timing cover, rocker arm covers, intake manifold, and any other parts that may need cleaning before installation. Replace all timing belts per application. Replace oil and oil filter. Replace all tune-up items such as plugs, cap, rotor, fuel and air filter, PCV valve, and other specific to the engine. Check and adjust valves and timing to factory specifications. Radiator should be thoroughly cleaned or replaced. Thermostat should be replaced. Fuel lines should be checked for debris and flow. Pick-up screen to oil pump must be replaced or cleaned. Prime lubrication system to avoid dry start. Inspect wire harness for broken wires or insulation damage. When starting engine, do not accelerate above idle until normal oil pressure has been reached. Change oil and filter after first 500 miles of use. Engines are typically guaranteed not to have a cracked block, cracked heads, a bad crankshaft, excessive smoking, or excessive oil consumption. Any other parts that are included are not guaranteed and are only provided for customer’s convenience. It is recommended that the installer replace the rear main seal; inspect all other seals and gaskets prior to installing the engine.
All USED TRANSMISSIONS installed must meet the following requirements to qualify for supplier warranty:
Thoroughly clean all units such as oil pan and any other part that needs cleaning before assembly. Replace the oil and filter for an automatic transmission. Replace and check the fluid level for a standard transmission. Replace front and rear seals. Check all lines and linkage for damage or blockage. Torque converters must be replaced with the transmission.
ENGINE PARTS such as heads, blocks, cranks, etc. are guaranteed to have no cracks and to be rebuildable to within manufacturer’s specifications. Valves, springs, studs, pins, gears, nuts, bolts, etc. are not guaranteed.
STARTERS, GENERATORS and ALTERNATORS are guaranteed to work at time of purchase. Suppliers assume no responsibility for improper installation, faulty regulator, or poor electrical connections.
RADIATORS and HEATERS are guaranteed against leaks and coolant flow restrictions provided that all other coolant components are performing as required. The warranty does not include damage to radiator that does not interfere with its function. No other warranty applies.
BRAKE PARTS are guaranteed to be rebuildable within manufacturer’s specifications. No guarantee on hardware such as shoes, pads, springs, bearings, etc.
NOT COVERED UNDER WARRANTY: The following are not covered under warranty unless otherwise stated on your invoice. Purchaser's loss of time, loss of use of the vehicle, towing expenses, installation expense, commercial loss or consequential damages, claims that result from an accident, abuse, neglect, alteration, improper maintenance or improper installation, parts installed in a vehicle used for commercial, racing or off road purposes, or any part used under conditions that would cause greater than normal wear, or parts used for other than original application.
Miscellaneous: This Agreement shall be treated as though it were executed and performed in Florida, and shall be governed by and construed in accordance with the laws of the State of Florida (without regard to conflict of law principles). Any cause of action by you with respect to the site (and/or any information, documents, products or services related thereto) must be instituted within one (1) year after the cause of action arose or be forever waived and barred. All actions shall be subject to the limitations set forth in other sections. The language in this Agreement shall be interpreted as to its fair meaning and not strictly for or against any party. Any rule of construction to the effect that ambiguities are to be resolved against the drafting party shall not apply in interpreting this Agreement. This Agreement and all incorporated agreements and your information may be automatically assigned by us in our sole discretion to a third party in the event of an acquisition, sale or merger. If any provision of this agreement is held illegal, invalid or unenforceable for any reason, that provision shall be enforced to the maximum extent permissible, and the other provisions of this Agreement shall remain in full force and effect. If any provision of this Agreement is held illegal, invalid or unenforceable, it shall be replaced, to the extent possible, with a legal, valid, and unenforceable provision that is similar in tenor to the illegal, invalid, or unenforceable provision as is legally possible. To the extent that anything in or associated with the site is in conflict or inconsistent with this Agreement, this Agreement shall take precedence. Our failure to enforce any provision of this Agreement shall not be deemed a waiver of such provision nor of the right to enforce such provision. Our rights under this Agreement shall survive any termination of this Agreement. The title, headings and captions of this Agreement are provided for convenience only and shall have no effect on the construction of the terms of this agreement.
Jurisdiction, Venue And Arbitration: All disputes and controversies of every kind and nature between SearchParts.com, or National Parts and purchaser, arising out of or relating to this agreement, transaction or purchase, shall be settled by mandatory binding arbitration in Jacksonville, Duval County, Florida, in accordance with Florida arbitration law. The arbitrator shall be an arbitrator mutually agreeable to the parties, or if the parties cannot agree, an arbitrator appointed by the Court. Jurisdiction and venue for any and all disputes and controversies between the parties shall be in Jacksonville, Duval County, Florida, and decided in accordance with Florida law. The prevailing party in any arbitration proceeding or Court matter shall be entitled to reimbursement for reasonable attorney's fees and costs, defined to include fees paid to arbitrators and expert witnesses. This agreement includes any legal controversy or legal claim arising out of or relating to this agreement or our services, excluding legal action taken by us relating to site operations and/or intellectual property.
